——从中国近现代宪法的发展展开

摘要：合宪性审查在中国社会有独特的发展路径、建构模式和制度功能。作为一项重要的宪法制度，合宪性审查肇端于清末民初，随着近代宪法的产生和发展而变化演进，并最终在中国共产党的领导下得到切实落实和新的发展。新中国合宪性审查的建立与推进，尤其是具有中国特色的合宪性审查制度与机构设置，既是源自中国历史社会权力结构的选择，也是宪法和法律以及社会发展的必然要求。同时，合宪性审查制度的有效运行，将对中国的法律与政治生活产生重要的功能性影响，从而使党更好地发挥“总揽全局，协调各方”的领导核心作用，进一步践行“为人民服务”的政治承诺。

The Power Logic of Constitutional Review and China's Path

——From the Development of China's Modern Constitution

Abstract:Constitutional review has its unique development path, construction mode and system function in Chinese society.As an important constitutional system, constitutional review started in the late Qing Dynasty and the early Republic of China. It changed and evolved with the emergence and development of modern constitution and was finally implemented and developed under the leadership of the Communist Party of China.The establishment and promotion of new China's constitutional review, especially the constitutional review system and institutional setup with Chinese characteristics, is not only a choice of China's historical and social power structure, but also an inevitable requirement of the Constitution, laws and social development.At the same time, the effective operation of the constitutional review system will have an important functional impact on Chinese legal and political life, so that the Party can better play its leading core role of "commanding the overall situation and coordinating all parties", and further fulfill its political commitment of "serving the people".
