中日韩自贸区与东北亚能源互联网构建中的法律问题

摘  要：中日韩自贸区与东北亚能源互联网都极具发展潜力，两者的发展也面临着类似阻碍。同时，中日韩自贸区谈判与东北亚能源互联网的构建存在着相互促进的因素，前者可以为后者提供法律框架，后者可以促进前者的顺利进行。本文致力于分析在中日韩自贸区谈判的背景下，东北亚能源互联网建设中的法律问题，提出通过借鉴国际法现有规定，并针对能源的特征，借助“中日韩自贸协定”中的规则为这些法律问题提供解决方案。

China-Japan-Korea FTA and Legal Issues regarding the Construction of the Northeast Asia Energy Interconnection

Abstract:China-Japan-Korea Free Trade Agreement and the Northeast Asia energy interconnection have great potential for further development but facing some similar obstacles. In the meantime, there are mutually reinforcing factors in the negotiations of China-Japan-Korea FTA and the construction of Northeast Asia energy interconnection. The former can provide a legal framework for the latter, which can facilitate the smooth conduct of the former. This paper focuses on analyzing the legal issues in constructing the Northeast Asia energy interconnection under the background of negotiating the China-Japan-Korea FTA. It is proposed that by referring to the existing provisions of international law and aiming at the characteristics of energy, providing a solution to the legal issues in relation to the China-Japan-Korea FTA.
