京津冀司法协同治理的模式转型

摘  要：京津冀协同发展的核心是京津冀三地的整体性协同，不仅包括司法的一体化协同运行，而且需要三地各级法院加强司法协同并为之提供有力保障。着眼于强化保障和创新服务，京津冀三地法院应当以强化审判执行核心职能、推进非诉机制多元化解纠纷、运用案例优势普法宣传教育等作为着力点，深化区域治理主体协同、矛盾纠纷化解协同、社会风险防控协同、跨域规则体系协同等机制，构建跨区域的司法协同治理网络。目前，京津冀司法协同制度规范的基本框架基本形成，实践中诸如司法协作、网上立案等取得了较大的进展，同时面临着司法协同治理的内卷化、同质化、表层化、悬浮化等困境，亟待运用技术治理的逻辑，不断深化京津冀司法协同的技术治理机制，加强司法对社会治理要素的整合利用，以机制建设为重点增强京津冀司法协同治理的动力和活力，强化法域概念加强京津冀司法协同的形势研判，实现京津冀司法协同治理的模式转型。

The Model Transformation of Beijing, Tianjin and Hebei Cooperative Governance

Abstract：The core of the coordinated development of Beijing, Tianjin and Hebei is the integrated coordination among the three regions, which not only includes the integrated judicial operation, but also requires the courts at all levels to strengthen the judicial coordination and provide a strong guarantee for it. With an emphasis on strengthening guarantee and innovative services, the courts of Beijing, Tianjin and Hebei should strengthen the core functions of trial execution, promote diversified non-lawsuit mechanism to resolve disputes, and use case advantages to popularize law and education, deepen the coordination of regional governance bodies, coordination of resolving conflicts and disputes, coordination of social risk prevention and control, and coordination of cross-regional rule system, and build a cross-regional judicial collaborative governance network. At present, the basic framework of the Beijing-Tianjin-Hebei judicial collaborative system specification will be basically in place, in the practice of judicial cooperation, such as online filing made greater progress, at the same time, facing a judicial cooperative governance within the volume, homogeneity, surface, suspension, etc, to be using the logic of governance, the deepening of Beijing, Tianjin and Hebei judicial coordination technology governance mechanism, strengthen the judicial integration of social governance elements is used, with emphasis on the mechanism construction, strengthen the power and vitality of the Beijing, Tianjin and Hebei judicial cooperative governance, strengthening the legal concept of Beijing, Tianjin and Hebei judicial coordination situation, realize the coordinated governance model transformation of Beijing, Tianjin and Hebei justice.
