修辞理论的实践转向及拓展研究

摘要：法律修辞学是一门实践学科，应关注新时代的实践背景，回应新时代的社会需求，同时关注历史文化传统和地方特色。法律修辞学需要经历一场转变，即从修辞技巧的战术研究迈向思维方式的战略研究。同时需要警惕修辞的喧宾夺主现象，探寻法律概念的修辞意义，注重借鉴多种理论资源，关注修辞生发的社会环境。此外还需注意从法律修辞与法律解释、法律修辞与法律逻辑、法律修辞与法律语言、法律修辞与法美学等多视角、多维度来拓展法律修辞学的理论研究与实践应用。法律修辞学需要一个实践智慧的立场。

A Study on The Practical Turn and Expansion of Rhetorical Theory

Absrtact: legal rhetoric is a practical subject, which should pay attention to the practical background of the new era, respond to the social needs of the new era, and pay attention to the historical and cultural traditions and local characteristics at the same time. Legal rhetoric needs to go through a change, that is, from the tactical research of rhetorical skills to the strategic research of thinking mode. At the same time, it is necessary to be alert to the rhetorical replacement of original meaning, to explore the rhetorical meaning of legal concepts, to draw lessons from a variety of theoretical resources, and to pay attention to the social environment in which rhetoric grows. In addition, we should also pay attention to the theoretical research and practical application of legal rhetoric from many perspectives, such as legal rhetoric and legal interpretation, legal rhetoric and legal logic, legal rhetoric and legal language, legal rhetoric and legal aesthetics. Legal rhetoric requires a position of practical wisdom.
