“一带一路”背景下我国国际商事法庭的建设与完善

摘 要：在“一带一路”倡议下，我国涉外商事案件不断增多，创造一个有利于国际商事往来的法治环境并建立良好的国际商事争端解决机制体系已成为我国当前的重要任务。我国 2018 年 6 月成立的国际商事法庭是一项具有创新性的制度构建，包括三位一体式争端解决机制的建立、国际商事专家委员会制度的创设以及在传统审理程序上的创新，但其中依然存在许多需要完善的地方，例如国际调解机构及专家委员会作出的调解协议性质认定和审查形式问题、国际商事法庭管辖权过窄与一审终审制合理性问题、涉外案件管辖双轨制可能导致的司法不公问题、国际商事专家委员会定位问题及国际商事法庭判决的承认与执行问题等。因此，需要借鉴他国经验并结合我国国情，不断完善我国国际商事法庭的相关制度，以打造出具有中国特色的国际商事争端解决机制，并加强我国在相关领域的话语权。关键词：“一带一路”；国际争端解决机制；国际商事法庭；国际商事专家委员会
Institutional Innovation and Improvement of China International Commercial Court under the Background of‘the Belt and Road’ Liu Junmin Tong Zhengkai Abstract: Under ‘The Belt and Road Initiative’, the number of foreign-related commercial cases in China has been and continues to increase quite rapidly. It has been a crucial task for China to create an international commercial dispute settlement mechanism system which can superbly contribute to international business trades. The China International Commercial Court (CICC), established in June, 2018, is a new and innovative institution, which includes: the establishment of a trinity dispute resolution mechanism, the creation of the Expert Committee, and the revisal of the traditional trial procedures. However, many qualities of the CICC still require improvement. These improvements include clarifying the nature of and review process of agreements made through the reconciliations of international conciliation institutions and the Expert Committee, reviewing the jurisdiction of CICC, correcting the judicatory injustice which may result from dual-track jurisdiction, reforming the virtue of the Expert Committee, and expanding the recognition and enforcement of judgments made by CICC. It is therefore necessary for China to continuously improve CICC on the basis of other countries’ experiences and the condition of China as a whole, leading to the creation of an international commercial dispute settlement mechanism which includes Chinese characteristics, raising China’s influence in related fields.
