法治逻辑、法理思维能解决什么问题？

摘要：法理思维与法治逻辑关系密切，谈论法理思维就不能不涉及到法理与逻辑的关联。这两个维度的结合构成法理思维或法治逻辑。法理思维是根据法治要求或法治之理展开的思考方式；是以逻辑思维规则的使用来满足法治的要求。超越法律思维、法治思维的法理思维，结合法律方法的综合使用，找到了法治实现的思维路径；能够较好处理逻辑与经验的关系；从而为法治话语体系建构提供了思维方式；为法治中国建设塑造思维规则；为法律逻辑的拓展研究提供新的领域等等。

What Problems Can Logic of Rule by Law and Jurisprudential Thinking Solve?

Abstract: Jurisprudential thinking is closely related to the logic of rule by law. Talking about jurisprudential thinking cannot be isolated from the connection between jurisprudence and logic. The combination of these two dimensions constitutes jurisprudential thinking or the logic of rule by law. Jurisprudential thinking is a way of thinking based on the requirements of the rule by law or the rule of law theory. It makes use of logical thinking rules to meet the requirements of the rule of law. Beyond the legal thinking and the rule by law thinking, combined with the comprehensive use of legal methods, we can find the way of thinking that the rule of law is realized; meanwhile, it can better handle the relationship between logic and experience, provide a way of thinking for the construction of the legal discourse system, shape the rules of thinking for the rule of law in China, and provide new fields for the expansion of legal logic research.
