宪法与社会主义价值观的融合发展及实现机制*

摘要：社会主义核心价值观同社会主义的本质特征相互关联，具有历史正当性与时代优越性，反映了中国本土的价值趣味和价值理想。它对转型期中国面临的多元价值冲突具有应对优势，却面临认同困境，这是它同宪法融合发展的主要原因。社会主义核心价值观与宪法的融合遵循党的领导、人民当家作主与依法治国的有机结合的政治逻辑与依法治国与以德治国相结合的法理基础。其实现机制包含直接成为宪法的规范组成部分、以体系解释的思路实现宪法文本内涵变迁、作为政策性指导的依据三个框架部分，并通过合宪性审查机制进行技术保障。为了推进社会主义核心价值观容宪法的实质融合，以及促使其进一步指导社会交往行动，重点领域基本法律对宪法相关规定的继承既要贯彻落实核心价值观，也要维持自身逻辑自洽、体系完整。为此，在未来的变迁中应当扩宽覆盖面，丰富价值倾向、立法宗旨、具体内容，促进法律规制模式的多元化发展与创新。

The Fusion and Realization Mechanism of Constitution and Socialist Values

Abstract: The core values ​​of socialism and the essential characteristics of socialism are related to each other. They have historical legitimacy and the superiority of the times, reflecting the value interests and ideals of China's native land. It has the advantage of coping with the multiple value conflicts facing China during the transition period, but faces the dilemma of identification, which is the reason for its integration and development with the Constitution. The integration of socialist core values ​​and the constitution follows the political logic of the organic integration of the party ’s leadership, the people being the masters of the country, and the rule of law, and the legal basis of combining the rule of law and the rule of virtue. Its implementation mechanism includes three framework parts that directly become the normative part of the constitution, realize the change of the connotation of the constitution text with the system interpretation, and serve as the basis for policy guidance, and provide technical guarantee through the constitutionality review mechanism. In order to promote the substantive integration of the socialist core values ​​and the Constitution and to further guide social interaction, the inheritance of the relevant laws of the basic laws in key areas must not only implement the core values, but also maintain self-consistent logic and system integrity. To this end, in the future changes, we should expand coverage, enrich value trends, legislative purposes, and specific content, and promote the diversified development and innovation of legal regulatory models.
