民法典继承编之遗产家庭住房的先取权和终生使用权立法研究*

（西南政法大学民商法学院；重庆 401120） 摘要：我国《继承法》没有规定配偶等特殊继承人对遗产中的家庭住房享有先取权和终生使用的权利。目前我国“民法典继承编”正在编纂之中，本文以遗产中家庭住房的先取权和终生使用权为研究对象，立足我国司法实践中存在的问题和社会现实需要，分析该制度的设立基础，并在考察、评析我国十省市被调查民众相关遗产处理习惯、域外立法例和我国诸继承法学者建议稿的基础上，提出在“民法典继承编”中增设遗产中家庭住房的先取权和终生使用权的立法建议。 关键词：民法典继承编；遗产分割；家庭住房；先取权；终生使用权
Research on Legislation of the Right of First Taking and the Right of
Lifetime Use of the Inheritance Family Housing in Succession Law of Chinese Civil Code

Abstract: Succession Law of PRC does not stipulate that spouse and other special heirs enjoys the right of first taking or lifetime use of the family housing in the inheritance. At present, " Succession Law of Chinese Civil Code" is be under compilation, this paper taking the right of first taking and lifetime use of family housing in the inheritance as the research object. Based on the problems existing in the judicial practice and social reality needs in our country, the paper analysis the establishment of the system, Chinese people's heritage related habits, related foreign legislation and the suggestions of Chinese scholars on Succession Law of PRC, puts forward to add the right of first taking and lifetime use of family housing in "the Succession of Chinese Civil Code ".
