论版权确界规范的表现形式

摘  要： 规则和标准是法律规范的两种主要表现形式。我国版权法在确立版权边界时宜采取以标准为主的表现形式，规则之使用应局限于有限范围内。标准在内容上的不确定会造成作品的低效利用，助推版权范围扩张，从而对版权法中“激励”与“接触”相平衡的内在机制造成破坏。可以通过引入介于规则与标准二者之间的“要素”形式、确立版权判例制度等路径防范由此可能产生的问题。

On the Norm Expression Forms for Delineating Copyright Boundaries

Abstract：Rules and standards are two main expression forms of legal norms. It is suitable to adopt standards as main norm expression forms during Delineating copyright boundaries and using rules in copyright law should be limited in scope. Since the content indefiniteness of standards may cause inefficient use of works and aid copyright scope expansion, therefore harming the inner mechanism of balancing “incentive” and “access” in copyright law, such methods as bringing in “elements” existing between rules and standards and building copyright precedent systems should be adopted to prevent the occurring of such problems.
